Your dispute is referred to FairClaims -
you are sent a sign-up link
Sign up and tell us a little about your dispute. We’ll then invite the other party to join.
Once both parties have signed up, you’ll be assigned an Arbitrator and you can write your full statement and upload any evidence. Evidence can include contracts, pictures, emails, text, etc.
You will have up until 5 days prior to the Hearing date to upload your Evidence.
(you can go to www.fairclaims.com/evidence for suggestions)
Your Arbitrator will send both parties 5 potential dates and times for your hearing. Both parties will give their preferences on these times and the Arbitrator will select the one that works best for both sides.
The hearing will be a 30 minute online video chat. Your Arbitrator will first ask both sides to tell their side of the story. Then the Arbitrator will ask specific questions to both sides based on the statements and evidence. If the Arbitrator asks for additional evidence, you’ll have 48 hours after the hearing to upload it. After this timeframe, you will have 24 more hours to submit your final statement to address any opposing evidence.
Within 5 days after the hearing, the Arbitrator will render the decision. You’ll receive an email notifying you of the decision and can log into our website to see the full decision summary and reasoning.
If the decision results in one side owing the other side money, payment must be made within 14 days. The decision from the Arbitrator is legal and court enforceable.
About your Hearing:
You must join your hearing to share your side of the dispute, virtually. You are welcome to turn the video portion off, however the Arbitrator will need to hear you. If you are not present for your Hearing, the Arbitrator will continue on and hear from the parties that are present. The Arbitrator assigned to your case will still take into account all the evidence: verbal, written and visually presented and does not only rely on your Hearing statement.
