Step 1: You are owed money, what now?

We at FairClaims understand that after going through the arbitration process and winning your case, you expect payment in full. Fortunately, that is exactly what happens in the majority of cases. Sometimes, however, the owing party does not pay promptly. When that happens, you will have to go through the additional step of having a court “confirm” your arbitration award. This converts the award into a judgment, which means you can then use legal tools (such as garnishment of wages) to collect on your judgment. 

The process of confirming your arbitration award and collecting your judgment can be cumbersome and time consuming. For that reason, it is often in your interest to try to work things out directly with the owing party, if at all possible (for example, by agreeing to a payment plan so that the owing party has more time to come up with the money owed). 

We are not trying to scare you away from the confirmation process, we simply want you to be fully informed when you decide how to proceed. 

If you would like to try to work it out, you may utilize the Settlement portal on the Dashboard (click on the Discussion tab) or contact the owing party directly and begin exploring how they might pay you. 

Please know that FairClaims does not provide contact information for any parties due to our privacy policy. We have had parties seek out a private process server who can skip trace or access the opposing party’s information. Again, FairClaims will not provide contact information for the opposing party.
